Zovon Terms of Service
Welcome to Zovon!
These Terms of Service (the “Terms”) explain the rules that apply whenever you use our video platform — a place where you can search for popular videos uploaded by creators, watch them, share them and browse everything without paying — and they create a legally binding agreement between you and Zovon. Every time you access or use our platform Services, you confirm that you accept these Terms and promise to follow all of them. If you cannot agree to any part of these Terms, you should not access or use our platform Services at all.
Important Notice
Please note that this agreement has a binding arbitration clause, which you can read in Section 18. Except for a few specific kinds of disputes, like claims about intellectual property infringement, you and Zovon both agree that every dispute will be handled through binding arbitration, and both of us give up the right to bring or join class action lawsuits.
1. Eligibility Requirements
- Minimum Age: To register an account or use Zovon’s full platform Services, you must be at least eighteen years old. If some premium features are introduced later, they may come with a higher minimum age, and you will be told about this clearly the first time you open those features.
- Legal Capacity: When you use Zovon’s services, you confirm that you have full legal capacity to enter into a binding agreement, to follow every term in this document, and to respect all applicable local, national and international laws and regulations.
- Entity Use Authorization: Where you access Zovon for a company or a public body, you represent that you possess the full authority to commit that entity to every term laid down in these Terms.
- Minor Access Prohibition: Nobody under the age of eighteen is allowed to register an account or use Zovon’s platform Services. We may permanently close any account that we reasonably believe belongs to an underage user, and we do not have to give notice first.
2. User License
- Personal Use License: Zovon gives you a personal, worldwide, royalty-free, non-transferable license to access and use all of our platform Services — including finding trending user-submitted videos, streaming, sharing and browsing content — only for their intended purposes. This license stays valid only while you keep complying with every provision of these Terms.
- Automatic Updates: Our platform Services may download and install software updates automatically, such as fixes for video playback issues and newly released features. You can switch automatic updates off in the system settings of your mobile device.
- License Restrictions: Approval in writing from Zovon’s management team must be obtained before you copy, modify, sell, reverse engineer or sublicense any of Zovon’s proprietary software and services.
3. Content License to Zovon
- Ownership of Your Content: When you create, upload or share media — including videos, public comments, photos and captions, which we call “Your Content” — you keep full legal ownership of everything you post. At the same time, you give Zovon a worldwide, royalty-free, sublicensable license to host, store, display, stream, format adjust (for example, optimizing video resolution for different device screen sizes) and distribute Your Content. We use this license only to operate, maintain and improve our video platform, including making your uploaded videos available to other users.
- License for Public Content: For all media you post in public areas of the platform, such as trending video feeds and public comment sections, you give Zovon a perpetual, worldwide, royalty-free, sublicensable license to publicly broadcast, display, reproduce and create derivative works from that content. For example, your uploaded video might be featured in a curated “Top Viral Videos” compilation. This license also lets us show your full name and profile image next to your published content, and you will not receive any extra payment for that.
- Content Moderation Rights: Zovon has the right to review, remove or modify any of Your Content at any time, for example by deleting videos that violate these Terms. However, we have no legal obligation to actively monitor all user-generated content on the platform. You are the only one responsible for all of Your Content that you post on Zovon.
- Advertising Consent: Because you get free access to video browsing and content sharing features, you agree that Zovon may show commercial advertisements across all platform Services.
4. Your Responsibility for Uploaded Content
- Full Liability for Content: You are completely legally responsible for all of Your Content that you publish on Zovon. You must make sure that your uploads do not infringe any third-party rights — including the copyright in background music used in your videos and trademark rights — and do not break any applicable local or national laws, such as laws against defamation or obscenity.
- Prohibited Content: You are forbidden from uploading or sharing content that is unlawful, damaging, discriminatory (on grounds of race, gender, religion or other protected characteristics), graphically violent, sexually explicit, or that encourages harassment, exploitation or criminal behaviour. This extends to child sexual abuse material (CSAM), hate speech and footage showing illegal acts in progress.
- Reporting Violations: You can report illegal or inappropriate content, such as violent videos, through our built-in reporting tool or by emailing our official service inbox: [email protected]. After a breach of these Terms is confirmed, our team may remove the content and suspend or terminate the accounts responsible.
5. Privacy of Your Data
Protecting your personal privacy matters a lot to our team. Our official Privacy Statement, which you can find inside the Zovon mobile application, explains in detail how we collect, use and share your personal data in connection with our video platform Services. By using any Zovon service, you fully consent to all data practices described in that Privacy Statement.
6. Prohibited Conduct
While using Zovon’s Services, you must not do any of the following:
- Harassing, threatening, intimidating or impersonating other users. This covers, for example, leaving abusive remarks on other creators’ videos and passing yourself off as another individual.
- Interfering with the platform’s security systems, circumventing access controls, or relying on automated tools such as bots to harvest video data, inflate view counts artificially or upset the ordinary operation of the platform.
- Distributing malicious software, spam or unlawful material, including child sexual abuse material (CSAM), across any portion of our platform Services.
- Employing Zovon’s features for commercial ends in the absence of prior written approval from our management team, such as offering physical goods for sale through video comments or promoting outside services.
- Breaching third-party intellectual property rights, whether by uploading videos that use copyrighted music without authorisation or by evading digital rights management (DRM) systems incorporated into the platform.
- Engaging in money laundering, fraudulent activity or the exploitation of vulnerable people. Any and all activity connected with child sexual abuse material (CSAM) is dealt with under our strict zero-tolerance policy.
Zero-Tolerance Child Safety Policy
Zovon has a firm zero-tolerance policy for all child sexual abuse material (CSAM) on our platform. Please report any suspected prohibited material immediately. Our team will remove all related content, suspend or permanently ban the responsible account, and cooperate fully with law enforcement authorities during any investigation.
7. Copyright Policy
Zovon holds the intellectual property rights of creators and rights holders in high regard. Where you hold a good faith belief that material on Zovon, such as a video uploaded by another user, infringes your copyright, a written infringement notice listing every item below should be emailed to [email protected]:
- Your physical or electronic signature.
- A thorough account of the copyrighted work that you maintain has been infringed.
- The precise location of the allegedly infringing material, comprising complete video URLs or directions for finding it inside the app.
- All of your contact particulars: name, mailing address, phone number and email address.
- A declaration, made under penalty of perjury, that you possess a good faith belief that the use complained of is not sanctioned by the copyright owner, its agent or the law.
Accounts belonging to registered users who repeatedly commit confirmed copyright infringement may be closed by Zovon on a permanent basis.
8. Account Rules
- Account Security: Looking after your account login credentials, which includes protecting your password, falls entirely on you. You are not allowed to disclose your login information or to enter your Zovon account through third-party software that has not been authorised.
- Account Usage Rules: Registering several duplicate accounts, selling or handing over your account, or bringing back accounts that were deactivated for policy violations is not permitted unless official platform guidelines expressly allow it.
- Reporting Unauthorized Access: Should you become aware of signs that your account has been accessed without authorisation — for example videos appearing that you did not upload — our support team should be contacted without delay at [email protected].
9. Content Moderation
- Automated and Human Review: Two review systems are operated by Zovon: automated detection software built to spot violent or sexually explicit video content, and trained human moderators who inspect every published item for policy breaches. That said, 100% accurate detection of every form of prohibited content posted by users cannot be assured.
- User Reporting: Using the reporting tool built into the platform, you can flag unsuitable content, including harmful videos and spam comments. Our moderation team aims to finish reviewing all submitted violation reports within 24 hours, and after a policy breach is confirmed it may take down the offending content or suspend accounts on a temporary or permanent basis.
10. In-App Purchases and Payments
In the event that Zovon later introduces optional premium features or virtual products — for instance ad-free video streaming or entry to exclusive locked trending content:
- Transparent Pricing: Every price is displayed in full before you complete any purchase. Payment processing is undertaken by authorised third-party payment providers, among them the Apple App Store and Google Play Store.
- No Refund Policy: Save where applicable consumer protection legislation, such as EU consumer regulations, demands otherwise, purchases that have been completed are final and cannot be refunded. Subscriptions renew on an automatic basis unless you cancel through your app store account no later than twenty-four hours ahead of the following billing date. Cancelling your subscription does not give you any entitlement to a refund for the part of the current subscription period that remains unused.
- EU Consumer Rights: A full refund for subscription purchases may be requested by users resident in the European Union within fourteen calendar days of purchase. The refund right exists solely where you have not accessed or made use of any premium features during that fourteen-day period.
11. Mobile Data Charges
Every mobile data charge, text messaging fee and other telecommunications cost connected with your use of Zovon’s Services — for example streaming videos or uploading them over a cellular connection — is your own obligation. Your mobile service provider is the right place to turn for information about data rates and billing.
12. Anti-Slavery and Anti-Human Trafficking Policy
Slavery, human trafficking and the exploitation of vulnerable people are prohibited by Zovon in all their forms. Suspected violations should be reported to our official email address [email protected]. A complete investigation will be carried out by our management team, all violating content will be removed, and full cooperation will be extended to the relevant law enforcement authorities.
13. Anti-Fraud and Compliance
- Scam Prevention: Never transfer money, reveal financial information such as credit card numbers, or become party to questionable financial dealings with other platform users. Every verified scam — for instance users soliciting payment through video comments — should be reported to our service inbox at [email protected].
- Anti-Money Laundering (AML) Compliance: To satisfy mandatory anti-money laundering requirements under the law, Zovon may ask you for government-issued identity documents. If you decline, or fail, to supply the identification requested, access to your account may be suspended temporarily.
14. Service Changes and Account Termination
- Service Modification Rights: Zovon keeps the right to introduce new features such as in-app video editing tools, to withdraw existing features, to suspend the service temporarily, or to bring all Zovon services to an end at any moment, whether or not notice is given in advance. Where major changes to core services occur — for example the permanent removal of core video-sharing functionality — reasonable efforts will be made to inform registered users.
- Account Suspension and Termination: For confirmed breaches of these Terms, lengthy periods of account inactivity, or conduct that is harmful, our management team may suspend your account temporarily or close it permanently and strip away all access to our Services, with or without written notice issued in advance. Once your account is terminated, every platform feature becomes unavailable to you, including your uploaded videos and any premium services you purchased.
15. Indemnification
You undertake to indemnify, defend and hold harmless Zovon, its affiliated companies, directors, employees and authorised third-party agents from every claim, damage, liability, cost and legal expense (including attorney fees in full) that arises out of your use of Zovon’s Services, any Your Content that you post on the platform (including copyright infringement lawsuits triggered by your uploaded videos), or any breach of these Terms that is confirmed against you.
16. Disclaimers
- As-Is Service: All Zovon Services are delivered strictly on an “as is” and “as available” footing, with no express or implied warranties of any description. We make no promise of uninterrupted service, error-free video playback, or the complete accuracy and safety of all user-generated content found on the platform.
- No Liability for User-Generated Content: Zovon accepts no legal responsibility for offensive, unlawful or deceptive material posted by other users, including harmful videos and false comments. Everything user-generated that you encounter on the platform is consumed at your own risk.
17. Limitation of Liability
Neither Zovon nor its partner entities will bear liability for indirect, consequential or punitive damages of any kind whatsoever. Our aggregate maximum liability across all claims will not exceed the greater of one hundred United States Dollars (USD 100) or the total sum you have paid to Zovon during the preceding twelve consecutive calendar months.
18. Binding Arbitration
- Dispute Resolution: Rather than proceeding through court litigation, the great majority of disputes between you and Zovon are required to be settled by binding arbitration. A mutually agreed arbitration forum, such as USIETAC, will administer the arbitration in line with the official procedural rules of that forum.
- Class Action Waiver: Every dispute is to be arbitrated on an individual basis. This agreement does not allow consolidated or class action lawsuits.
- Opt-Out Right: Within thirty calendar days of your first use of the platform Services, you may choose to opt out of this binding arbitration clause. Written notice of your opt-out must be delivered to Zovon’s management team by email at [email protected] or to the physical address set out in the Zovon mobile app; the notice is required to state your full name, the email address registered to your account and an unambiguous statement that you are opting out of the arbitration clause.
19. Intellectual Property Statement
Every video uploaded by a registered user to the Zovon platform must be an original work of that uploading user’s own creation. Complete intellectual property ownership rights in the uploaded content — covering, among others, copyright, trademark, patent and trade secret rights — must be held by each uploader. Registered users may not upload or publish material that encroaches on third-party intellectual property rights, whether through unauthorised copying, adaptation, editing or clipping of externally owned video, audio, text or image files. Upon identification of confirmed infringing content by our moderation team, Zovon holds the immediate right to erase the violating material permanently and retains the right to hold the responsible user fully accountable at law. Where measurable financial losses are suffered by Zovon as a direct consequence of the infringing conduct, the responsible user must reimburse Zovon for all such losses.
20. Governing Law
The civil laws of the State of Delaware, to the exclusion of its conflict of law principles, are the exclusive governing law of these Terms.
21. Severability
Any provision of these Terms that a court of competent jurisdiction finds unenforceable will be severed from the agreement, while all remaining provisions continue in full legal force and effect.
22. Supplementary Terms
Separate supplementary terms may apply to certain platform features, such as official creator monetization programmes. When you first access the relevant feature, these supplementary terms will be presented to you, and upon acceptance they become legally binding components of this agreement.
23. General Terms
- Entire Agreement: This set of Terms of Service, along with our Privacy Statement and any supplementary feature terms, forms the complete agreement between you and Zovon and replaces every earlier oral or written arrangement.
- No Third-Party Beneficiaries: No enforceable rights are conferred on any third party by this agreement, including other users of Zovon.
- Non-Waiver: If Zovon’s management team declines to enforce a particular provision of these Terms on a given occasion, our entitlement to enforce that provision in later instances of verified policy violation is not surrendered.
- Assignment: Without prior written approval from Zovon’s management team, you may not assign or transfer the rights granted to you under these Terms. Zovon, for its part, may assign and transfer its rights and obligations under this agreement freely and at its sole discretion.
- English Language Priority: Where a conflict arises between translated versions of these Terms and the original English version, the original English version is the only version that carries legal authority.
